These notes are aimed at individual surveyors or property owners who are owed a specific sum of money under the terms of an award made under the Party Wall etc Act 1996, are faced with non-payment of that money, and therefore want to enforce payment through the courts.

They assume that the award to be enforced is a valid award, and has not been appealed within  the statutory 14 day appeal period. It guides you through sending a pre-action letter and thereafter issuing your claim on the government’s online claims service, giving you the necessary information and wording to do so.

The notes take the form of a pdf document which can be downloaded as often as a purchaser wishes for up to 365 days after purchase. A second pdf includes the necessary annexes to a pre-action protocol letter from a surveyor or business seeking to enforce payment.
